Anyone ever file a PayPal Claim against a Seller??

Hi folks,

I ordered a copy of the Spyderco Story from an online retailer ( I wont mention the name :mad: ) Paypal was sent Monday May 7. I recieved no email with an order confirmation. I have sent three emails and left three voicemails over the course of this week and have recieved no response whatsoever. I am getting a little upset.

The website made no mention of being closed, away on business, unavailable until....etc.

What should I do? I really hate to file a Claim with PayPal I would rather work it out privately but how do you do that with no communication from the seller.

Has anyone here had to file a claim. I imagine it is probably a long process.

Need your opinions and thank you in advance,

It's only been 5 days, I wouldn't worry just yet. Some sellers just aren't good with communication. As for filing a claim, I've only had to do it once, and it was resolved in about a week. Your mileage may vary.

i have. never got the sharpmaker i ordered. paypal eventually credited my account for $25 -- that was the max under their protection policy. the rest i had to eat. the guy wound up doing the same to a bunch of people. his store in texas had a phone number that was never answered, and a ton of complaints with the local BBB. it was a shame, because his track record before my order was solid -- the collapse happened just when i ordered a sharpmaker.

it takes a while with paypal. sometimes the communication with them was quick and helpful, other times a hassel. but in the end, you may only get a $25 credit.

I have as well, but it was after about a month of no product. The seller agreed to send another product, but I went through with the claim just the same. Once the second product sent did arrive, I sent the seller the payment I had been awarded form Paypal. Much of my concerns came from the lack of communication form the seller. Be mindful of the fact that once you open a claim, you only have a finite amount of time to settle before the claim is closed(for good). Otherwords, get satifaction from seller quickly or upgrade to full refund.

I too have done the merry little paypal jig.

The person in question ripped me off for all of 15 dollars, 11 of which were recovered.

Initiate a dispute with paypal, if they're ignoring you, they won't ignore paypal!

Any time you have a complaint like this, by all means contact eBay and/or PayPal. However, if your seller remains unresponsive, I also recommend that you fill out a complaint at the Internet Crime Complaint Center (IC3), which is a joint effort staffed by the FBI and the National White Collar Crime Center (NW3C). IC3 will forward your complaint to law enforcement agencies who have jurisdiction in the matter. More importantly, the IC3 adds the complaint to its database, and its personnel perform analysis and send out neatly packaged investigations to FBI Field Offices, US Postal Inspection, and other federal, state and local agencies. The IC3 analysts then will assist whichever agency opens a case on the matter by continuing to conduct analysis, preparing charts, graphs and other documents for court proceedings, etc.

Now, your complaint may not be picked up for investigation by a law enforcement agency, but, if it turns out that several hundred people have been victimized by the same seller/business, then there is a decent chance that a case will be initiated.

The complaint can be filled out at http://www.ic3.gov.

In addition, the IC3 site provides information on some of the latest internet scams. More consumer awareness type information can be found at http://www.lookstoogoodtobetrue.com.

I think you are jumping the gun by at least a week. Some sellers will wait for Pay Pal payments to actually show up in their account before they ship. I don't know for sure how long that takes, but I have seen it take three to four days for a payment I have made to show up on my bank account. Even if he shipped the instant the transaction was made, it isn't unusual for the US Snail...I mean Mail...to take a couple of weeks to get a package across the country.

If you are absolutely certain that the seller is trying to rob you, the first step in resolution is to request contact information from eBay. If you cannot contact the seller using the information eBay provides (or if the seller hangs up when you identify yourself, as happened to me) then the next step is to file a dispute with Pay Pal. You have forty-five days from the original transaction to file if I remember right.

For what it is worth, the one time I had to do so, I got back every penny, including the shipping.
I don't believe in safe queens, only in pre-need replacements.

I have never filed a claim but one was filed against me. I can tell you, I noticed that :D

I would wait about 2 weeks before filing the claim. If you dont have any contact for that amount of time, feel free to file the claim.

I have, twice. Once it was an online store that gave me the run around for 2 months about diamond rods for the sharpmaker, paypal investigated, and gave me a full refund. The second time was a forum deal, paypal denied that claim saying that it cannot get get involved if it's not a legitimate store, or an ebay auction. Good luck!

First of all, what State does the seller do business from? If you can
find that out then go to http://www.Google.com and enter that
State's Department of Consumer Protection and / or Attorney General.
Then, go to the Federal Trade Commission ( FTC ) -

Most of these sites offer "on-line" complaint forms. Good luck!

I've had to file several PayPal refund claims in the past year. I usually give the seller a good two weeks to ship the item and/or make communications with me. You know sometimes things happen and maybe the seller was unable to ship the item or check their eBay selling status. I just filed a claim this morning for non-receipt of an item that I bought on 5/12. Absolutely zero communications from seller and never received the item. I made two attempts via email to contact the seller with no response. Went to PayPal Resolution center and sent another message to seller from PayPal, no response. So this morning I filed an "escalation" for a refund. It usually takes about a week for PayPal to address the complaint. Out of about 3 or 4 claims I've made, PayPal always came through.

Well, I'm about to do the paypal dance a second time.

I'm dangerously close to starting a claim on an ebay seller who has communicated once since my purchase two weeks ago (to let me know the item MAY be delayed owing to problems with his shipping account) and has not responded or replied hence.

One initially files a "Dispute." One can immediately escalate it to a "claim", or one can hope that the Paypal-sent dispute email will be enough to prompt the other party to pony up.
