In my opinion the creature on the "item" that Simona posted looks much more like a bee than a butterfly.

People call it the ".45 Long Colt" to distinguish it from the .45 ACP round which is rather shorther. As you know, the .45 Long Colt was initally designed for the Colt Model 1873 Single Action Army Revolver, the famed "Peacemaker" of the Old West. Back in black powder days, they made the cartridge longer so that they could fit in lager powder loadings for more power. You can't be serious can you? Its pretty low to start attacking the Spyderco crew who work hard to keep this forum going. Random thought for the day to all you Benchmade fans who see nothing wrong with what they did.
Try marketing a Mickey Mouse watch without asking Disney's permission, and see what happens.
The only difference is the relative amount of money between the parties. Disney would take you to court in a heartbeat (judging from past cases) because:
A) Mickey Mouse is a registered trademark of Disney
B) They have a LOT more money than you, so they can afford it.
Would your 10,000 unauthorized Mickey Mouse watches hurt the Disney corporation? Not a chance. Would that stop them from coming after you? Again, not a chance.
That mouse is their property, and they will defend it.
So why will this probably not go to court? Given the track record of our legal system, my bet for the outcome would be TWO bankrupt knife companies and a bunch of wealthy lawyers. While I wouldn't mind losing Benchmade, I'd like to see Spyderco stay in business.
Why all the anger directed at Benchmade? Wake up and smell the coffee! They violated the Spyderco trademark. Period. Full stop. I don't care WHY they did it, any more than I would care WHY someone stole my truck. That they did it is enough to set me off.

That was not an attack on Spyderco's employees as, to be honest, I overlooked the fact that as this is Spyderco's own forum, they would be the only people who could remove an offensive post. I applaud Simona for her attempt to derail it with some humor(even if it might have been a little much), but apparently we're all too concerned with proving who's right. These threads always seem to make lawyers out of all of us.
I've stayed out of it for the most part, but I've got some sarcastic comments that need to be made. So please, open up your sense of humor for once.

You see a round hole, you think Spyderco, THAT is why the trademark was issued, and it was rightly issued. Sure it was someone else's picture first, but noone is trying to make any money off of it, and that's the difference between that picture and the hole in the Vex. That hole screams Spyderco. Putting the Spyderco hole on a red class BM undermines the hole. The hole means Spyderco quality, and by putting on a knife with abysmal fit and finish like a BM red class, it's going to give the Spyderhole a bad name. BM is trying to make money off the Spyderco look while at the same discrediting the hole. Conspiracy theory? Absolutely

If you compile the majority of what those who support Benchmade in this vexing endeavor have stated: we stalwart Spyderco sympathsizers: have no life outside of the internet, are raving madmen frothing at the mouth in a huge tizzy, behaving in a manner that reflects poorly on Spyderco, and generally shouldn't care about two business in the act of business.smcfalls13 wrote:LOL... :D

I find all this rather humorous. At best, the vast majority of us, camp here in the Spyderco forums, the place were we spend most of our internet time, and say something like "no Benchmade for me." Why this would bother someone on the "outside" is rather puzzling. We didn't all scamper on over to Benchmade forums, sign up just yesterday, or choose to suddenly start voicing our opinions and scream our case. We don't realy make a big deal on the generic blade forums I frequent. We voice our opinions on it and try to move on, all in a calm manner at Spyderco.com/forums. Others come here and tell us we are wrong, disregard that seemingly slippery concept known as "doing the right thing", and ignore all the logic and case examples we provide.

I once got up in arms about something somewhat similiar to this... a cheap, off brand ripoff of the spyderfly that was so minimally altered as to be insulting... Sal, of course, had wisdom to impart in that situation... not to say that this monkey business is the same (after all, BM does kind of share the same market as Spyderco... present company excluded). If I may, I would like to quote his response to my rant from that thread (entitled "What a bunch of thieves")
