A Hard Earned Knife Rights Victory! Freedom (Finally) Wins in New York!

Nine years of hard work and effort, including eight years of costly Federal litigation and the threat of losing big time at the U.S. Supreme Court (see below), has finally convinced New York Governor Andrew Cuomo to sign A5944, repealing the state’s bans on Gravity Knives. Cuomo previously vetoed two similar bills which Knife Rights Director of Legislative Affairs, Todd Rathner, also worked on tirelessly in Albany.

Although the bill leaves the definition of a gravity knife intact, the statutory repeals make the knives legal, stripping New York City and District Attorney Cyrus Vance, Jr. of their ability to continue to abuse the definition of a gravity knife and continue to arrest and prosecute people by claiming a common lock blade folding knife or utility knife is an illegal gravity knife

The repeal is effective immediately. :D :D

Unfortunately, this is unlikely to be the end of knife owners being harassed by the New York Police Department. I am European, so not familiar with US knife laws. I just recall that crazy story someone posted here, where he had to face a trial for carrying a Para 3 and the cops thought it was (too) visible (or something like that, can´t remember exactly).

Now: The underlying for THAT has changed for the better? Would be great of course...

Still not legal in the subway (as per comments by NYPD in the nytimes and in the rules of conduct for the subway)

What are the implications of that? If it is legal in the city but not in the subway, and they find it on the person in the subway, they can arrest or fine them, yet, if they are outside of the subway, they are free and clear? How would that stand up in a court?

Not sure how that'd work - lots of politicians in NYC that think that because they're now legal, everyone's going to get stabbed now

Critter, I have a question related to this about concealed weapons laws in various cities and states. The articles about New York seem to indicate that people in both that state and elsewhere, in which there are laws against locking and one hand opening folders, should keep them in the pocket or not visibly clipped to where they can be seen from the outside. But, could the authorities in those locales use concealed weapons laws on the person in question, and say "Since the knife is hidden, this makes it a concealed weapon", or, as long as it is not a firearm, and as long as it is within the local legal framework (ie no daggers or true spring driven knives), it is not considered a concealed weapon? How does that work?

When does something become legally categorized as a "concealed weapon"?

Every state and municipality in the USA could be different. Knife Rights has a FREE app for phones that you can download and look at the laws in your area.

Then I would go over and check out USCCA's website and see what lawyers they have for your area, and if you have any questions about the legality of carrying a knife in your jurisdiction, you give one a call.
