I reread the comments and still can't find "tough luck" in this thread. Not even a suggestion it was. The people are pretty good about that kind of thing here. There are some ideas on how to keep it from happening again.
If you would actually read my post instead of just grasping at straws for an opportunity to be Spyderco's white knight, you would see that I was merely trying to explain to OP what should happen in these situations so he knows his rights as a consumer. I felt that was more welcoming to our new friend than some people who said it was an expensive lesson for him. I never addressed Spyderco and demanded anything of them. Nice try though.
You aren't very good at this are you? :) Thanks for being the protector of his rights though. Every forum needs one of those, eh? :D
You're the one that isn't very good at this.
Everything he said is factually correct. The shipper is responsible when an item is lost or stolen. A lot of people don't understand their rights as a lot of companies try to get out of their responsibilities. I am not, nor is Steel City saying Spyderco is acting shady, but it IS there responsibility to rectify this situation and make things right with the OP.
Any compensation from UPS to spyderco has nothing to do with the OP. Spyderco is 100% legally responsible to the OP, not UPS. And it is NOT incredibly generous for Spyderco to replace or reimburse the OP - it is their legal responsibility. Nor, do they have any right to drag things out waiting for UPS to work out their claim with Spyderco.
Sorry if you think that it's rude to explain the situation, but it's not. If you think that Spyderco is not responsible for the OP's knives then you are ignorant of the law.
The only snag in this situation is that the OP doesn't have any leverage with Spyderco should they choose to drag things out or not fully compensate (Again, I'm NOT suggesting that Spyderco is behaving that way at all - just discussing the legal ramifications). It's really a lost cause trying to force a company to pay if they choose not to for such a small amount, particularly if you're out of state - the legal costs will far exceed the value of the knives.
Had this been an item purchased from Spyderco (or a dealer) with a CC that was lost or stolen in shipping, then the choice would be to reship an identical item or refund the card. They don't have a choice, nor can they require you to wait on the UPS settlement. If they don't refund or reship then a single phone call to your CC company will have the charges reversed - again, because that's the law!
Steel City understands the law and was attempting to explain to the OP what his rights are, nothing rude about that at all.
