Sounds like some loophole BS to get it thrown out, likely because the judge didn't want to deal with it. Vendors who can't be bothered to check the authenticity of the products they sell need to be held accountable.

Sounds procedural to me. Given that the ruling was "without prejudice", it's almost like the judge is saying "sue in Maine".
Perhaps there's something in patent law that, in spite of its federal scope, requires suits to be made nearer the act of infringement.
I hope Spyderco presses on. The Kittery Trading Post is a fifteen-minute drive from me and it really bothers me they would knowingly purvey counterfeits generally and Spydercos particularly with impunity. Some cleansing is in order.

We just got back from Maine, the Acadia National Forest area. Truly awesome natural beauty. Live lobs for $5.00 lb which we ate nearly every day. We did go by the Kittery Trading Post but the folks with us weren't interested. Glad we didn't stop. I have ordered online from them in the past. Needless to say they will never have any more of my business. Sad that KTP would knowingly sell fake merchandise and that a judge would let them slide. One would think a Colorado judge would want to protect the rights of a Colorado business. If one person in Colorado purchased a fake Spyderco advertised online from KTP it makes it the purview of the Colorado legal system.
For folks who haven't visited Maine, the coastal areas are amazing. Baa Habaa :D Wintaa Harbaa, :D Southwest Harbaa, :D Camden, and more, all incredibly beautiful. The people of Maine were very friendly, cordial, and helpful. We weren't used to it getting light at 4:30 in the morning. :eek: Made for long days that aided us in seeing as much as we could in our time there. If you should have the opportunity to visit, take it. You will be amazed.

I like Maine. I have not been to the ocean side. I have been to the mountainous part. Really a beautiful state.

Yes, Maine is awesome. Eating lobster on the shore at one of the lobster pounds is as good as it gets. Counterfeits are not awesome though, and I hope Spyderco has success if they decide to continue legal action.

It's hard to angle Spyderco's lawyers' reason for filing in Colorado until you think about how much easier precedent is if it's a lawsuit in your back yard vs. a different federal court.
I would rather get rulings in my back yard too. I hope Spyderco can write their lawyer's travel into the settlement.

I live near KTP.
They recently stopped selling Spyderco knives.
I recall on a couple of occasions seeing a fake Para or Millie being sold in the used knife case and marked as fake. I don't believe they sold new fakes.
Years ago they used to have good deals on used knives. Not so anymore. I still go there for their big sales but rarely buy more than a pair of socks.

Good to know. I'll feel better shopping at KTP now.
However, I wonder if KTP will resume taking Spydies in trade, given the known difficulties of separating wheat from chaff.
