Last night I was at my uncle & aunts for dinner with my parents. So we eat and then it's time for dessert.



My aunt it trying to open this box, and I say do you need a knife? So she hands me the box and I take out my Spyderco Native and open it up. Then proceed to open the box.





My soon-to-be 22 year old cousin says to me "Well, that's a little illegal there." I reply with "No, it's not" "Yes it is" etc. I was have a VERY bad night - and this didn't help me. Then my aunt said to my cousin "No no, up to 6" is legal" Wonder what he would have said if I used my assisted opening Flash I instead? haha Funny thing is, he is supposedly going to Police academy this fall. His older brother is ALREADY a Police officer - sadly he was working last night.



I was going to go ask him, why he thought my Native was illegal. However, before I could do so - he said he was going out.



It does getting bothersome "Why do you carry a knife?" "That is so sharp! Be careful!" "That looks so mean!"



According to my research and info from Blade Forums... In Ohio - any size folder is OK - fixed blade up to 4.5 inch conceale

kinda like the fun I have up here... canadian law is very basic regarding knives... no balis, no pushdaggers, no autos... nothing said about length. few notes about concealed <i>weapons</i>(but as well all know in the innocent until proven guilty society, that it's just a tool until used as a weapon, or in the commision of a crime)...

I carry a few on me, usually 4-5 at a time, sometimes 7-8...
all fully legal, even though my fixed carry isn't always visable(jacket worn open, covers em) and my neck carry is 95% under my shirt. try and find me an auto that can be opened as fast from pocket as my military or cricket... never mind my fixed.

I've lost count of how many times I get asked if my knives are legal. Gotten my direct family to carry and appreciate knives though. My dad has a couple(drawer for around the house, multi in the van, and a folder for the bike), Mom carries a few(buck minitool, ladybug, and a small needlenose multi) and has a BM rescue hook for the bike... My sister? well, she at least appreciates good quality kitchen knives, buying her a good pocket knife for this spring before she goes on her annual camping trip.

the rest of the family is for the most part oblivious to knives, they appreciate quality when they use mine, but don't own more than $5 kitchen knives. The only one who has "good quality" is my uncle that hunts, and even then it's gerber and schrade. The rest are almost afraid of my knives.

when they need a knife I tend to hand em my beater or a fixed. the beater is pretty sheeple friendly(spydie ss 'fly pe) though sharp enough to handle enough.

No, seriously, perhaps here, in the Czech is knife paradise, i think,knife laws :

.. no blade limit ...so,balisongs,double blade, all autos, push daggers, all fixed blades, concealed knives,bayonets,all-sharp-what-you-can-imagine, simply all is allowed ...<img src="smile.gif" width=15 height=15 align=middle border=0>
If you want wear sword from movie Conan, so wear it, on the sidewalk...

Only-- when you meet some LEOs and they see your knife, they say: "****, from where you have so nice knife ??!<img src="smile.gif" width=15 height=15 align=middle border=0>

With firearms its another, you must go to one day course, pay aprox.40usd, you get paper, with this paper you go to police, thay give you gun licence and you can buy .357Magnum or so ...

Case from last week, what happened:: One idiot, who bought his first firearm in his life, and in addition, Colt Anaconda, came with his wife to their weekendhouse.. so, he have had new gun...so he was in interest try it, so this idiot gave paper target to house wall, from outside and shoot to... 15cm wall only, from bricks, he shot and his wife fall to floor dead inside their weekendhouse....

Next, also from last week:: Next idiot bought firearm, come back to home and start manipulate with loaded gun in apartment, and shot by mistake his own, 7yrs.old son, to his leg, but fortunately he is alive...
But caliber .40auto in leg of 7yrs.child -- its nothing for fun.

Sometime, when you are reading this cases, you are thinking, if peoples have brain ....

jaxon: yep, they had it out a few times before it got colder...

they got 8 weeks off work after the accident, and my the end of week 6, with my dad walking us(me and my sister) through it, we had the bike in working condition, just needed body work on cracked panels and such. One of the guys he rides with also does the autobody class at out local tech college and got the work done by students.

They only got 4-5 rides in before it got too cold again... but they were back on it. Mom's bike(750 magna) needs some work on it still, should be up and working by the summer I think. So after she takes the course they'll each have bikes on the road. Means I'll have to get another hook for my dad, and a folder for her... :D

I was wondering: A sporting goods store near me, sells Spydie Endura (with almost 4" blade if I remember correctly). Does that mean in that city Endura is legal?

I can't see it's legal to sell - illegal to carry. Well... I can't believe some of these dumb knife laws either ugh

It's been my experience that most police officers don't know the legal lengths for thier jurisdictions. Every one that I have asked gives me a different answer.

Why carry a knife? because it's better to be judged by 12 than carried by 6 <img src="wink.gif" width=15 height=15 align=middle border=0>
As about the Czech knife paradise (as described by Sia), I don't think it will last, as they'll have to comply to the European Union rules regarding that matter...

In finland it is legal to have ewerygind blades but its illegal carry knife in bubilic area.
"Why do you carry a knife?" My ansver is it`s a natural thing and why not?

Great to hear of your folks recovery Patrick. Sorry though about the weather getting too cold. I guess I tend to be spoiled and forget that some folks can't ride all year. I'm also a wimp and avoid riding if temp is less than in the 50s F. But that means I've ridden the last three days. Or was that 30 days?<img src="wink.gif" width=15 height=15 align=middle border=0>

Well, a store selling a particular knife is no guarantee that it is legal to carry. Knife laws, like many things come in a variety of flavors.

Federal law is easy, aside from banning the transport of autos across state lines, a law which has been on the books for over 45 years and has NEVER been enforced, there are no restrictions.

State laws, on the other hand, do exist, are enforced to at least some degree, and vary widely when it comes to knives. Some states make it flat out illegal to possess a given type of knife. Switchblades and gravity knives fall into that category here in New York. Others allow you to have it, but not to carry it. Daggers and dirks fall into that category in New York state, legal to sell, legal to own, legal to transport, just not legal to carry. What's the difference between transporting and carrying? In a word, accessibility. If the knife is in a box inside a bag, you are transporting it. If it's loose in your pocket or sheathed on your belt and available for immediate use, you are carrying. To further complicate things, some states equate hidden with furtive and devious, and assume anyone carrying a knife concealed is probably up to no good, and therefor require that it be carried so it is visible in order to be legal. Others, like New York, equate visible with implied threat, and say it's ok to carry most knives as long as the are concealed. Finally, there is the only category most of us feel is reasonable and justified, the laws that make ANY knife illegal if it is used to threaten, coerce, or criminally harm another person. That's the only one that makes sense, and, when you think about it, is the only one really needed as it puts the onus on the behavior and not the knife.

Unfortunately, it does not end there. On top of state laws, there are county laws, municipal ordinances, and local "building" policies to consider. I live and work in Rensselaer County, but the easiest way for me to get to work is to cross the river into Albany then cross it again further north. There are some knives that are legal to carry by state law, and not restricted in Rensselaer, but are illegal to carry in Albany. And then there are knives that are legal to carry in Albany, but against the rules to bring into certain buildings, some State buildings prohibit entry with any knife.

Well I talked to my cousin (Police officer) and he said carrying my Native is no problem. I said what about 4" Spyderco Military - said don't worry about it. He said next time I see him, he show me the ORC and show me there is nothing to worry about.


I'm getting a little confused here.

Tom (on Bladeforums) said: " Therefore, except for a small slip joint, I would advise never to carry concealed in Ohio. Have that pocket clip or belt pouch showing. It would be pretty sad to get a felony record and possibly spend time and $$ when there is an easy way to eliminate the risk."

and

"Some Ohio municipal ordinances, however, set the legal limit for concealed carry at 2.5". Violation of an ordinance is not a felony, but would usually result in a fine and probable confiscation of your concealed knife."

According to Tom, you can get a felony for carrying concealed - yet for breaking an ordinance, it really isn't anything.

How can ANYONE in the legal system (LEO, Judge, Lawyer, etc), expect anyone to know what the laws really are regarding knives. Sounds like it can vary from LEO to LEO etc. Someone just tell me what the solid hard laws are, and I'll stay in them. Sad thing is, no one know what they are! Because no one thought "Hey! It may be good to actually define what is to big!" ugh!

So you could say, "Well, if it's not concealed or it's small slipjoint it's fine... Otherwise, you could be OK or you could be in serious **** trouble." Look, I don't like the tuck in my shirt all the time, which means if it's clipped to me jeans, you can't see it.

Right now: I have jeans on, with my Native and Flash I clipped. However, I have a t-shirt generally covering it up - I also have a sweatshirt on, as it is still winter. Even though it's clipped, it's generally covered, which could mean: felony! ugh!!!

Every time I think about this, I get more and more and MORE upset! I'm not out to hurt people or scare people by carrying a knife. I like knives, they're a hobby of mine, I like to carry them as they can be very fun and handy. Yet, I could be arrested and charged a felony. How lovely eh?

I don't know if I mentioned this or not here, my friend's father is a lawyer. And I asked him to check and get back to me what kind of knife laws he can find. I'll also ask him what to say, if I have to explain to a Police officer why I might have a Spydie Military or Civie or Emerson Commander or something on me. Or heck - on what to say about carrying any knife, of any size.
